Amateur fishing

Art. 22. (1) Amateur fishing shall be carried out by natural persons, who have license for amateur fishing.

(3) (amend. SG 94/05) For the issuing and the re-certifying of the license for amateur fishing fee shall be collected according to tariff of art. 17a, para 4.

(4) (new – SG 94/05; suppl. – SG 59/12) The members of the associations of art. 11 shall pay 80 percent of the defined fee for issuing and re-certification of the license for amateur fishing after presenting of membership card of the respective association, certified for the calendar year concerned.

Art. 22a. (new – SG 94/05) (1) (amend. – SG 36/08; amend. – SG 43/08; amend. – SG 80/09; suppl. – SG 19/11, in force from 09.04.2011) The licenses for amateur fishing shall be printed by EAFA and shall be distributed by its territorial units, the state forest holdings, the state hunting farms, the organizations of art. 11 and other persons under conditions and by order determine with ordinance by the Minister of Agriculture and Foods.

(2) The license for amateur fishing shall be personal and it cannot be conceded to third persons.

(3) License for amateur fishing shall be issued for a term of one week, one month, six months and one year according to model determined with the ordinance of para 1.

(4) (amend. – SG 59/12) The persons who disseminate licenses for amateur fishing shall transfer to EAFA 80 percent of the value of the license under conditions and by order determined in the ordinance of para 1.

Art. 23. (1) (amend. SG 94/05) Individuals can carry out amateur fishing without license in the waters of the Black Sea observing the requirements of chapter four.

(2) (suppl. SG 94/05; amend. – SG 36/08) Children up to 14 years of age and the people with disabilities can carry out amateur fishing with license for fishing free of charge in the sites for amateur fishing, provided that:

  1. children up to 14 years of age are granted with license for amateur fishing valid until they turn 14;
  2. handicapped persons up to 65 years of age shall be granted with license for amateur fishing valid for a period corresponding to the document, certifying the respective damage;
  3. handicapped persons whose damage is for life shall be granted with license for amateur fishing of unlimited duration.

(3) (amend. SG 94/05; suppl. – SG 59/12) The persons over 60 years or the women and 65 years for the men, as well as the persons between 14 and 18 years of age can carry out amateur fishing with permission against payment of fee for license in extent of 50 percent of the fee of art. 22, para 3.

(4) (suppl. SG 94/05) The STCFA and the organizations of art. 11 shall make proposals for stimulating of the development of the amateur fishing among the youth:

  1. (amend. – SG 36/08; amend. – SG 80/09) before the Minister of Agriculture and Foods for detaching of state dams or zones from them as study – practical complex and determine the conditions and the order for their use;
  2. before the respective municipal council for determining of appropriate water sites.

(5) (new – SG 59/12) The persons below 14 years of age shall carry on amateur fishing only with a companion holding a ticket for amateur fishing.

Art. 24. (1) The persons, exercising amateur fishing, shall be obliged:

  1. (amend. – SG 59/12) to use not more than 3 fishing rods (sticks) for fishing with mounted on them up to two hooks (single or double) in the artificial water sites, in the Black Sea and Danube river; in the waters of the Black Sea a bunch can be put on one of the fishing rods.
  2. (amend. – SG 59/12) to use two fishing rods (sticks) with mounted up to 2 hooks (single or double) at fishing in the rivers, the old river beds, the lakes and swamps by the sea, the Danube river;
  3. to record the catch from each fishing hike with kinds and quantity (in kilograms and numbers) in the licenses for amateur fishing;
  4. to carry during a fishing hike the licenses for amateur fishing and to present hem to the control bodies on request.

(2) (new – SG 59/12) The use of triple hooks shall be permitted only for fishing with artificial baits or for fishing of predatory fish with a living or dead fish baits.

(3) (suppl. SG 94/05; prev. text of Para 02, amend. – SG 59/12) After one day fishing hike, when carrying out fishing in the weekends or feast days, the fishermen shall preserve for themselves up to 2 kilograms trout fishes, but not more than 6. In working days the fishermen shall release back any captured trout fish. In respect of any other type of fish the fishermen shall keep up to 3 kilograms, except single specimen with bigger weight. In case of catch of frogs and crabs they shall preserve up to 50 specimen. In cases of a catch larger than specified, the specimen caught shall be immediately released in the water regardless of their condition.

(4) (suppl. SG 94/05; prev. text of Para 03, amend. – SG 59/12) The caught fish and the other aquatic organisms of para 3 cannot be subject to purchase and sale.

(5) (amend. SG 94/05; prev. text of Para 04, amend. – SG 59/12) The amateur fishing shall be permitted only during the light part of the day and night during all days of the week, out of the period of the ban of art. 32, para 1.

(6) (new – SG 94/05; prev. text of Para 05, amend. – SG 59/12) The order, conditions and water sites, where night-time amateur fishing is allowed, shall be determined in an order of the Minister of the Agriculture and Foods.

(7) (new – SG 94/05; amend. – SG 36/08; prev. text of Para 06, amend. – SG 59/12) At carrying out amateur fishing organized by the association of art. 11 in sites in which is assigned to them the management of the fish resources by the order of art. 15a the persons must have license for amateur fishing.

(8) (new – SG 59/12) The amateur fishing of quoted types of fish shall be prohibited.

Art. 24a. (new – SG 94/05) (1) (amend. – SG 59/12) at conducting sport competitions for catch of fish EAFA shall exercise control of observing the provisions of this Act except art. 24, para 1, items 1, 2, 3, para 5 and 7 and the observing the rules of the program of the competition.

(2) (amend. – SG 36/08; amend. – SG 80/09) Sport competitions for catch if fish in water sites – state property, shall be conducted in the period of the ban of art. 32 with permission of the Minister of Agriculture and Foods.

Administrative penalty provisions

Art. 64. (amend. SG 94/05; amend. – SG 59/12) Who implements amateur fishing without license for amateur fishing, in violation of art. 22, para 1, shall be punished with fine from 100 to 400 levs.

Art. 65. (amend. and suppl. – SG 59/12) Who carries out amateur fishing in violation of the requirements of art. 24, para 1 and 2, shall be punished with fine from 100 to 400 levs.

Art. 66. (1) (amend. – SG 59/12) Who catches and keeps fish in quantity, exceeding the determined, in violation of art. 24, para 3, shall be punished with fine from 50 to 200 levs, if he is not subject to graver penalty.

(2) (amend. – SG 59/12) Who sells or buys fish in violation of art. 24, para 4, shall be punished with fine from 300 to 600 levs, if he is not subject to graver penalty.

(3) (amend. – SG 59/12) Who carries out amateur fishing in violation of art. 24, para 5, shall be punished with fine from 400 to 650 levs.

(4) (new – SG 94/05; amend. – SG 59/12) Who carries out amateur fishing in violation of art. 24, para 8 shall be punished with fine from 300 to 600 levs if he is not subject to graver penalty.

(5) (new – SG 94/05) Who carries out amateur fishing in water site in which the management of the fish resources is assigned by the order of art. 15a without license and member card of the association shall be punished with fine from 100 to 300 levs if he is not subject to graver penalty.

Art. 67. (amend. SG 94/05) Who carries out amateur fishing out of the water sites and zones for amateur fishing, shall be punished with fine from 100 to 500 levs.
